수입항공제품의 승인절차 안내서

1. 목적. 이 안내서는 대한민국에 수입되는 항공 제품에 적용되는 특별 요건과 절차들을 규정한다. 이 특별 요건들은 해당 물품의 수출 시점에서 충족되어야 한다. 1. Purpose. This document, Guidance for Approval of Imported Civil Aeronautical Products, prescribes special requirements and procedures that apply to civil aeronautical products imported into the Republic of Korea (ROK). Applicable special requirements must be met at the time of export of the product. 　 2. 감항당국. 대한민국의 감항당국은 국토교통부이다. 2. Airworthiness Authority. The airworthiness authority for ROK is Ministry of Land, Infrastructure and Transportation (MOLIT). 2.1 국토교통부의 연락처. 항공제품의 형식설계 승인과 관련된 모든 문제점들은 다음의 주소로 연락한다. 2.1 MOLIT contact point. All questions relating to this guideline should be addressed to: <img id="140763279"> </img> 　 3. 적격성 3. Eligibility 3.1 대한민국의 형식증명 또는 형식증명승인은 대한민국 감항증명 발행에 있어서 선행되어야 하는 조건이다. 대한민국으로 수입되는 모든 항공기, 항공기용 엔진, 또는 프로펠러는 대한민국의 형식증명 또는 형식증명승인이 발행된 형식이어야 한다. 대한민국의 형식증명 또는 형식증명승인이 없이 수입되는 경우에는 감항증명의 발급과정에서 형식증명 또는 형식증명승인과 유사한 절차를 거쳐 해당 항공기 설계가 대한민국의 항공기기술기준에 부합함을 확인하게 된다. 3.1 The Korean type certificate or the Korean type certificate validation is a prerequisite to issuance of a Korean certificate of airworthiness. All aircraft, aircraft engines, and propellers imported into ROK may be of a type, which has been issued a Korean type certificate or a Korean type certificate validation. When an aircraft is imported without a Korean type certificate or a Korean type certificate validation, it is required to get through a similar process of the Korean type certificate or the Korean type certificate validation in compliance inspection for issuance of a certificate of airworthiness that ensures design conformity to applicable Korean Airworthiness Standards. 3.2 대한민국으로 수출되는 모든 Class Ⅰ 제품(항공기, 항공기용 엔진, 프로펠러)은 수출국 감항당국의 형식증명을 기 취득한 상태여야 하며, 국토교통부가 승인한 형식증명서 또는 형식증명승인서에 합치성을 설정하기 위한 추가 요건들에 적합해야한다. 3.2 All Class I products (aircraft, aircraft engines, and propellers) exported to the ROK must have obtained the exporting state's type certificate and also comply with additional requirements necessary for establishing conformance with a Korean type certificate or a Korean type certificate validation of each product. 3.3 대한민국으로 수출되는 Class II 및 III 제품들은 Class Ⅰ 제품에 대하여 규정된 국토교통부 승인 설계 또는 기준에 합치해야한다. 3.3 All Class II and Class III products to be exported to the ROK must conform to specified MOLIT-approved designs or standards for a ClassⅠproduct. 　 4. 항공기, 항공기용 엔진 및 프로펠러의 형식증명 및 형식증명 승인 　다음은 국토교통부의 형식증명 및 형식증명 승인에 과정을 요약한 것이다. 4. Type Certification or Type Certification Validation of Aircraft, Aircraft Engines and PropellersFollowing is a summary for issuance a Korean type certificate and a Korean type certificate validation. 4.1 외국 설계 및 제작 항공기 4.1 An Aircraft that Designed and Manufactured outside ROK (a) 외국의 신청자(형식증명 소유자 또는 대리인)는 자신의 감항당국을 통하여 국토교통부에 대한민국의 형식증명 또는 형식증명승인을 신청하여야 한다. (a) A foreign applicant, who is a type certificate holder or agent of TC holder, must apply for a Korean type certificate or a Korean type certificate validation through a civil aviation authority (CAA) of his or her country. (b) 국토교통부는 외국 신청자에게 인증을 위한 추가적인 요건이 있는 경우, 이를 알려준다. 특별조건, 추가적인 감항요건, 환경 및 운용요건을 포함하는 이러한 추가요건들은 대한민국의 인증 기준에 적합하도록 외국 감항당국의 인증 기준에 추가하여 국토교통부가 명시할 수 있다. (b) MOLIT will advise a foreign applicant of additional MOLIT certification requirements, if any. These additional requirements, including special requirements, additional airworthiness requirements, and environmental and operational requirements, may be specified by MOLIT in addition to certification standards of foreign CAA for ensuring compliance with the Korean airworthiness standards. (c) 추가적인 국토교통부 요구사항을 결정할 수 있도록 신청자는 국토교통부에 기술적 설명을 하여야 하며 이후 신청자의 시설에서 항공기와 외국 감항당국의 형식설계에 대한 사전 검사를 한다. 이 사전 검사는 형식설계자료 및 인증기준에 대한 검토를 포함하고 대표 항공기에 대한 시험비행도 포함할 수 있다. (c) In order to determine any additional MOLIT requirements, the applicant will give a technical briefing to MOLIT which will be followed by a familiarization inspection of the aircraft and type design of foreign CAA at the applicant's facilities. The familiarization inspection may include a review of the type design data and certification standards as well as test flights of a representative aircraft. (d) 국토교통부는 이러한 모든 방문을 필수적인 사항으로 간주하고 있다. 신청이 접수된 후 국토교통부가 방문을 하기까지 보통 몇 개월이 소요된다. 그러므로 적기에 형식증명을 신청하는 것이 중요하다. (d) MOLIT considers all such visits as essential. MOLIT's visits usually take place several months after an application is received so that it is important to make the application for type certification in a timely manner. 4.2 인증기준. 국토교통부의 형식증명 및 형식증명승인의 기준은 대한민국에서 제정하거나 채택하여 적용되는 요건이 된다. 신청자는 아래 수록한 기타 적용요건은 물론 현행 요건에서 포함하지 않는 특성을 포함시키기 위하여 국토교통부가 규정할 수 있는 특별조건을 만족시켜야 한다. 국토교통부 는 안전수준이 저해되지 않는 경우 예외사항을 인정할 수 있다. 4.2 Certification Standards. Standards for a Korean type certificate and a Korean type certificate validation are the requirements established or applied by the ROK. The applicant must meet any special conditions that may be stipulated by MOLIT in order to cover features not covered by other applicable requirements listed below and existing requirements. MOLIT may recognize exceptions in cases where safety is not impaired. (a) 외국 감항당국의 형식증명을 위해 감항당국에 제출된 신청일자에 유효한 대한민국의 해당 항공기기술기준 (a) Applicable Korean airworthiness standards in effect on the date of application is made to a foreign CAA for the its type certificate; or (b) 각 특별조건을 포함한 외국 감항당국 형식증명의 기준이 되는 해당 법규와 외국의 형식증명을 위하여 감항당국에 신청할 당시 유효한 대한민국 감항기술기준이 요구하는 안전수준을 제공하기 위하여 필요한 추가요건들. (b) Applicable regulations including special conditions that are basis for issuance of a type certificate by the foreign CAA and additional requirements necessary for satisfying safety criteria required by Korean airworthiness standards in effect at the time of application to the CAA for a foreign type certificate. 4.3 감항기준. 대한민국에서 정하여 고시하는 기술기준 및 관련 규정은 다음과 같다. 4.3 Airworthiness Standards Airworthiness standards and related regulations prescribed and notified by ROK are as following: <img id="140763679"> </img> ※ KAS: 항공기기술기준(Korean Airworthiness Standards) <img id="140763681"> </img> ※ KAS: Korean Airworthiness Standards OA : Order Authorization 4.4 요구되는 제출 문서 항공기의 대한민국 형식증명 또는 형식증명승인서의 발행을 위하여, 다음 또는 이와 동등한 문서가 제출되어야 한다. 4.4 Required documents The following or equivalent documents must be submitted for issuance of a Korean type certificate or a Korean type certificate validation of an aircraft. (a) 항공기 형식증명서 사본 (a) Copy of CAA's original Type Certificate (b) CAA TCDS의 최신판 (b) Latest issue of the CAA's Type Certificate Data Sheet (c) CAA 승인 비행 매뉴얼 및/또는 조종사 운영 핸드북 (c) CAA approved Flight Manual and/or Pilot's Operating Handbook (d) 형식설계의 기준 정의, 주요 부속품들의 3면도, 장착 및 주 구조물들을 포함한 항공기의 일반 기술적 설명 (d) General engineering description of the aircraft including definition of the type design standards, installations, primary structures, and three-view drawings of major assemblies. (e) 대한민국의 증명시점에 해당되는 기본 형식설계에 대한 Amended TC 및 STC 사항 (e) All amendments to TCs and STCs on basic type designs that are applicable at the time of certification by ROK (f) 제작자의 적합성 점검표 (f) Manufacturer's Compliance Checklist (g) 형식 설계가 대한민국의 감항 요건들을 만족시킨다는 적합성 보고서 (g) Compliance Reports showing that type design meets Korean airworthiness requirements (h) 장비, 운영, 정비, 오버홀, 수리 매뉴얼을 포함한 항공기의 계속 감항성 및 안전 운영에 필요한 문서 리스트 (h) List of documents necessary for continuing airworthiness and safe operation of aircraft including equipment, operation, maintenance, overhaul, and repair manuals (i) 표준최소장비목록(MMEL) (i) Master Minimum Equipment List (MMEL) (j) 정비심의위원회 보고서/정비계획서 (j) Maintenance Review Board (MRB) report / Maintenance Planning Data (MPD) (k) 항공기 및 주요 장비와 관련된 부품 카다로그 (k) Parts Catalogue relating to the aircraft and major equipment (l) 모든 관련 기술회보(SB) 및 적용되는 감항성개선지시서(AD)의 목록 (l) List of all incorporated Service Bulletins and applicable Airworthiness Directives (m) 적합성 요약 보고서 (m) Certification summary report (n) 일반 인테리어 배치 형상 도면 (n) General interior arrangement configuration drawings (o) 주도면 목록 (o) Master drawing list (p) 피로와 관련된 주요 부품의 운영 수명 목록 (p) List of service life for critical parts subject to fatigue 4.5 엔진 및 프로펠러 항공기 엔진 또는 프로펠러들의 형식증명 또는 형식증명승인의 절차(신청과정, 요구문서, 기술검토를 포함)는 항공기의 형식증명 또는 형식증명승인 절차와 동일하다. 4.5 Engines and Propellers Procedures for a Korean type certificate or a Korean type certificate validation of aircraft engines and propellers (including application process, required documents, and the engineering review) are the same as the procedures for a Korean type certification or a Korean type certificate validation of aircraft. 4.6 항공기 엔진에 관한 연료 방출 및 배출요건. 대한민국 항공법에 따라, 항공기 엔진은 연료방출 및 배출수준이 기술적으로 실용가능한 정도로 낮아야 하며 적용요건에 적합한 경우에만 형식증명 또는 형식증명승인을 받을 수 있다. 연료배출 및 방출에 대한 기준은 대한민국의 항공기기술기준 Part 36에 규정되어 있고 이에 대한 적합성이 충족되어야 된다. 4.6 Fuel Venting and Emissions Requirements For Aircraft Engines In accordance with the Aviation Act of ROK, aircraft engines will be issued a Korean type certificate or a Korean type certificate validation only when its fuel venting and emission levels are as low as technologically practicable and when in conformance with applicable requirements. Part 36 of Korean Airworthiness Standards are the fuel venting and emissions standards that must be met for conformance with relevant standards. Note : 1. 국토교통부는 적합성 검토를 위한 추가정보와 자료를 요구할 수 있으며, 제작자는 공식적으로 요청 받은 모든 자료들을 국토교통부에 제공해야 한다. 2. 위에 열거된 문서들은 국토교통부가 보관한다. 3. 신청자는 가능한 한 빨리 무료로 기타 관련자료와 모든 관련 SB를 포함한 위에 열거된 문서들의 개정판들(대한민국 형식증명과 관련된)을 국토교통부에 제출하여야 한다. 4. 자료의 제출은 하드카피 형태와 CD-ROM 또는DVD-ROM과 같은 전자파일 형태가 모두 가능하다 Note : 1. MOLIT may request additional information and data for compliance reviews, and the manufacturer should provide MOLIT with all of the officially requested documents. 2. The above listed documents will be kept in MOLIT. 3. The applicant must forward to MOLIT all revisions (pertinent to the Korean type certificate) to the above listed documents including all incorporated Service Bulletins and other pertinent data free of charge as soon as they are available. 4. Hard copies or electronic files such as CD-ROM or DVD-ROM are allowed for submittal. 　 5. 감항증명 취득을 위해 제출되어야 할 문서 다음 문서들을 국토교통부에 제공하여야 한다. 국토교통부는 대한민국의 감항증명 신청자가 국토교통부의 증명에 대한 적격성과 감항성 입증에 필요한 자료들을 제출하도록 요구하고 있다. 주: 신청자는 국토교통부의 인가가 요구되는 문서 1부를 준비하여야 한다. 5. Documents Required Obtaining Korean Airworthiness Certificates The following documents should be forwarded to MOLIT. MOLIT requires that an applicant for a Korean airworthiness certificate submit substantiating evidence as may be necessary for establishment of airworthiness and eligibility for certification by MOLIT. Note: Applicant will prepare additional 1 copy of documents required MOLIT approval 5.1 신규 항공기 5.1 New Aircraft (a) 항공기, 항공기용 엔진 및 프로펠러의 외국 감항당국의 수출 감항증명서 (a) CAA's Export Certificate of Airworthiness for aircraft, engines, and propellers (b) 고객선택사양 및 부가형식증명(STC)을 포함한 개조상태 (b) Modification status, including customer options incorporated and any supplemental type certificates (STCs) installed (c) 감항성개선지시서(AD) (c) Airworthiness Directives (1) 설계국 감항당국이 발행한 모든 감항성개선지시서(AD)를 만족함을 보여야 한다. 이때 선택적인 적합성 입증방법이 제시되었다면, 선택한 방법을 명시하여야 한다. (1) A declaration of compliance with all applicable Airworthiness Directives issued by a State of Design must be provided. Where optional means of compliance are offered, the means chosen shall be stated. (2) 반복적 적합성 요건을 포함하는 설계국 감항당국의 감항성개선지시서가 확인되어야 한다. 다음의 적합성 예정일에 관한 정보가 제공되어야 한다. (2) Airworthiness Directives issued by a State of Design containing repetitive compliance requirements must be identified. Information as to when the next compliance is due also must be provided. (d) 적용된 기술회보(SB) 및 긴급 기술회보(Alert SB) 목록 (d) List of all incorporated Service Bulletins and Alert Service Bulletins (e) 제품 비행시험 보고서 및 제품 시험비행 중 발생된 결함의 시정조치에 관한 설명 (e) Production flight test reports and any statements regarding the corrective actions taken for defects during the production flight test (f) 항공기, 엔진 및 프로펠러의 로그북 (f) Logbooks of aircraft, engines and propellers (g) 좌석 형상 승인 문서 (g) Seat configuration approval documents (h) 중량 및 평형 보고서 (h) Weight and Balance report (i) 콤파스 시스템 및 자기 콤파스 스윙의 기록 (i) Records of compass system and magnetic compass swing (j) 표준최소장비 목록 (j) Master Minimum equipment list (k) FDR/CVR 형식 및 데이터 형식 기록 및 해석 기록 (k) Flight Data Recorder/Cockpit Voice Recorder's type and data format records and interpretation reports (l) 시간/수명 한계 (l) Time/Life limitations (m) 요구되는 매뉴얼의 사본 (m) Required copies of manuals: <img id="140763707"> </img> Note : 1. "*"는 대한민국으로 수출된 특정 형식 및 모델의 최초 항공기에만 요구되는 수량을 의미 Note : 1. “*”means the quantity required only with the very first aircraft of a particular type and model exported to the ROK. Note : 2. "**"는 대한민국으로 수출되고 증명을 받은 동일 모델의 수량을 의미 Note : 2. “**”means the quantity required with the same model that has been exported to and certificated in the ROK. 5.2 중고 항공기. 5.1의 (a)항부터 (d)항까지 그리고 (f)항부터 (m)항까지의 요건에 추가하여, 중고 항공기에 대해서는 다음의 사항이 추가로 요구된다. 5.2 Used Aircraft. In addition to the requirements in paragraph 5.1 (a) through (d) and (f) through (m), the following are also required for used aircraft: (a) 다음을 포함하는 항공기, 엔진, 프로펠러, 부품 및 장비의 완전한 기록 (a) A complete history of aircraft, engines, propellers, components and equipment including: (1) 항공기가 의무 수명 한계가 되는 착륙/사이클 회수 (1) Number of landings/cycles where the aircraft is subject to mandatory life limitations. (2) 예전의 점검 주기 및 미래의 점검 주기를 포함한 항공기의 정비 프로그램 기록 (2) Record of aircraft's maintenance program that includes past and future check cycles (b) 항공기, 엔진, 프로펠러 또는 장비 부품이 의무 수명 한계가 되는 비행시간 (b) Flight times of aircraft, engines, propellers, and equipment for reaching their mandatory life limitations. (c) 항공기, 엔진, 프로펠러 또는 장비 부품이 승인된 오버홀 주기가 되는 비행시간 (c) Flight times of aircraft, engines, propellers, and equipment for reaching their approved overhaul periods (d) 날개, 꼬리날개, 회전익의 로터 또는 변속기 부품과 같은 주요 구조 부품들의 모든 변경사항들의 상세 설명 및 모든 교환 부품들의 기록 (d) Details of all changes of major structural components such as wings, tail planes, helicopter rotors or transmission components, and histories of all replaced parts (e) 각 건당 손상의 성질을 포함한 주요 구조 수리에 대한 설명 (e) Details of major structural repairs including the nature of damage in each case 5.3 항공기 감항증명의 소음 요건. 대한민국의 항공법에 따라, 소음의 수준은 가능한 낮으며, 적용되는 항공기 소음 요건에 해당 항공기가 적합한 경우에만 감항증명에 적격하다. 대한민국의 소음 요건은 항공기기술기준 Part 36을 기준으로 한다. 5.3 Noise Requirements for Airworthiness Certificate of Aircraft. In accordance with the Korean Aviation Act, an aircraft will qualify for airworthiness certificate only if its noise level is as low as technologically practicable and appropriate to the aircraft type in question. KAS Part 36 is the standards for conformance with Korean noise requirements. 　 6. Class II 및 III 제품의 수락절차 6. Procedures for Acceptance of Class II and Class III Products 6.1 Class II 제품 6.1 Class II Products (a) Class II 제품의 외국 제조자는 국토교통부의 인증을 위한 ClassⅠ제품에 장착을 적합하게 하기 위하여 국토교통부가 필요할 것으로 판단되는 자료와 문서들을 제공하여야 한다. (a) A foreign manufacturer of a Class II product is required to supply information and documentation deemed necessary by MOLIT for justifying its installation on a Class I product that requires MOLIT certification. (b) MOLIT의 Class II 제품의 장착 승인은 장착되는 Class I 제품의 부가형식증명을 통하여 허가된다. (b) MOLIT installation approval of a Class II product will be granted by the issuance of the Korean Supplemental Type Certificate for the Class I product on which it is installed. (c) 대한민국으로 수출되는 각 Class II 제품은 수출국의 법규에 따라 발행된 감항성 승인 태그를 가지고 있어야 하며, 모든 감항성개선지시서 및 관련 기술회보에 적합하다는 내용을 포함해야한다. (c) Each Class II product exported to the ROK must have an airworthiness approval tag from exporting CAA issued in accordance with appropriate regulations of an exporting state and must include a statement of compliance with all applicable Airworthiness Directives and incorporated Service Bulletins. 6.2 Class III 제품 6.2 Class III Products (a) Class III 제품은 다음과 같을 때, 대한민국 등록 항공기에 장착이 적합하다. (a) Class III Products are compatible for installation on Korean registered aircraft when the Class III Product: (1) 장착되는 Class I 제품의 설계자료에 적합하거나, 업체의 기준 (예: AN, SAE, NAS 등)에 적합함. (1) conforms to the design data for the Class I product of which it is a part or component, or conforms to industrial or national standards (e.g., AN, SAE, NAS, etc); (2) 제품이나 패키지 중 적당한 부분의 제조자의 이름 및 파트번호와 일치함. (2) is identical with the manufacturer's name and part number, either on the product or the packaging, whichever is appropriate; and (3) 안전운영을 위한 조건에 있음. (3) is a condition for safe operation. (b) Class III 제품의 경우, 국토교통부는 제품의 기준 및 명세서에 제품이 합치한다는 것을 보장하는 제조자의 원 문서를 합치성의 증거자료로서 승인한다. (b) For Class III products, MOLIT will accept as proof of conformity an original manufacturer's release document with a statement certifying the product conforms to its recognized standard or specification. 　 7. 계속 감항성. 국토교통부의 승인을 받은 외국의 제품 제조자는 국토교통부에 제품에 관한 계속 감항성 관련 자료들을 제공할 의무가 있다. 이것은 모든 위험한 운영곤란 상황, 이에 상응하는 설계 변경, 제안된 운영 사전경고 및 한계 정보들에 관한 국토교통부와의 즉각적인 정보교환을 포함한다. 7. Continuing Airworthiness. A foreign manufacturer of product approved by MOLIT is responsible for providing all information relating to continuing airworthiness to MOLIT. This includes prompt communication with MOLIT of all information regarding hazardous service difficulties, corresponding design corrections, proposed operational precautions and limitations. 　 8. (유효기간) 이 예규는 「훈령ㆍ예규 등의 발령 및 관리에 관한 규정」에 따라 이 예규를 발령한 후의 법령이나 현실 여건의 변화 등을 검토하여야 하는 2027년 5월 31일까지 효력을 가진다.
